2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order. By placing an order you represent that you are of legal age and that the information you provide is accurate and complete.

Certain products are intended for use by trained nail professionals. You are responsible for ensuring you have the training, licensing, and ventilation required to use professional products safely and in compliance with the regulations of your state or country.

3. Products, Pricing, and Availability

• Product images are provided for reference. Color, finish, and opacity may vary slightly between screens, batches, and application methods. Minor variation is not a defect.
• Prices are listed in US dollars (USD) and are exclusive of shipping, duties, and taxes unless stated otherwise at checkout.
• We reserve the right to modify prices, discontinue products, or limit quantities at any time without notice.
• We reserve the right to refuse or cancel any order, including orders that appear to be placed for resale without an authorized wholesale agreement, orders flagged for fraud, or orders that cannot be shipped legally to your destination.

4. Orders and Payment

Your order is an offer to purchase. A confirmation email acknowledges receipt of your order but does not constitute acceptance; acceptance occurs when the order ships. If an item is unavailable or was listed at an incorrect price, we may cancel the order and issue a full refund of the amount charged.

You are responsible for entering a complete and accurate shipping address. We are not responsible for orders shipped to an address entered incorrectly by the customer. Address changes can only be made before the order enters fulfillment.

5. Shipping and Delivery

• Orders typically ship within 2–3 business days of payment confirmation.
• Delivery estimates provided at checkout are estimates only and are not guaranteed. We are not liable for carrier delays, weather events, customs holds, or other circumstances outside our control.
• Some products are classified as hazardous materials and may be subject to shipping restrictions, surcharges, or ground-only transport. We may cancel and refund any item that cannot be shipped legally to your address.
• Risk of loss and title pass to you when the package is accepted by the carrier.

6. International Orders, Customs, and Import Duties

Unless the checkout expressly states that taxes or duties are prepaid, international orders ship on a Delivered At Place (DAP) basis.

All import duties, customs charges, VAT, tariffs, brokerage fees, and clearance fees not collected at checkout are the sole responsibility of the customer. These charges are levied by your country's customs authority, are not included in the product price or shipping cost you pay us, and are not within our control. We cannot calculate them in advance or predict them for your destination.

By placing an international order you agree that:

• You are the importer of record and are responsible for complying with all import laws and restrictions in your country.
• If you refuse to pay import duties, taxes, or clearance fees, no refund will be issued — whether the package is returned to us, abandoned, seized, or destroyed by customs. • If a returned or refused package results in additional charges billed to us by the carrier, we may invoice you for those charges.
• We will not undervalue orders, mark shipments as "gift," or misdeclare contents on customs forms.

8. Product Use, Safety, and Disclaimer

Our products are sold for cosmetic use on natural or enhanced nails, in accordance with the instructions provided. You are responsible for performing appropriate patch testing, following cure times and lamp specifications, and using adequate ventilation and personal protective equipment.

We are not responsible for allergic reactions, sensitization, skin or nail damage, or unsatisfactory results arising from misuse, improper curing, use by untrained persons, or combination with third-party products.

Products are provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose.

9. Intellectual Property

All content on this site — including the In.hYpe name and logo, product names, photography, video, packaging design, educational materials, and copy — is the property of Waymore Inc. or licensed to us, and is protected by intellectual property law. You may not reproduce, resell, or use our content or branding for commercial purposes without prior written permission.

Content you submit to us (reviews, photos, tags) may be used by us for marketing purposes without compensation, and you confirm you have the rights to any content you submit.

10. Wholesale and Professional Accounts

Wholesale, distributor, and ambassador arrangements are governed by a separate written agreement. Retail purchases made through this site do not grant any right to resell, rebrand, relabel, or distribute our products.

11. Limitation of Liability

To the maximum extent permitted by law, Waymore Inc., its officers, employees, and suppliers shall not be liable for any indirect, incidental, punitive, or consequential damages, including lost profits, lost income, or lost business, arising from your use of the site or products.

Our total liability for any claim shall not exceed the amount you paid for the product giving rise to the claim.

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, United States, without regard to conflict of law principles. Any dispute shall be brought exclusively in the state or federal courts located in Middlesex County, Massachusetts.

Nothing in these Terms limits any non-waivable statutory rights you may have as a consumer in your country of residence.
